    Three years since filing next week..

    I know that sounds good. I mean we've paid $37000 into it but I have just been so depressed these last two months. Everything that could go wrong and continues to do so.
    Dog emergency, AC emergency, Hoa dues emergency, fractured wrist which made me break the toliet, so new toliet, bounced checks and fees, but what has me most upset is we wrote a $300 check to the AC guy who is a friend of my sons, he held it for a week and lo and behold he cashed it yesterday at his bank and I didn't discover until this morning that my dear bless his heart stroke surviving husband went to the store with his debit card and I don't have enough money in the bank to cover this. My wedding ring is in pawn.... Life is just NOT good right now.

      No.. I don't think our creditors will get a penny. It's taxes, car and house arrears.

        I thought maybe you could defer a payment or two (after talking to your attorney)..i know it's possible while in a 100% payback plan...maybe you could phone your attorney and see if there's any sugestion he/she may have. Good luck.

          Are you in a five-year or three-year plan? You might want to talk to your trustee about deferring two of the payments. He has the ability to grant that request (usually). The two months are skipped, but then added on to the end of your plan, so it moves your discharge/completion out a couple of months overall.

          IF you'll have the money to pay it off in full on your next payday, perhaps a small (like $100) payday loan could keep the AC check from bouncing. I know they're expensive (probably $20 to $25 per hundred), but it might not be more expensive than an NSF plus a returned fee from the AC guy. I have no idea if you need trustee approval to get a small PDL if you're paying it off the next payday. But don't get it if it will only make your situation worse, and you can't pay it in full next payday.

          Otherwise, since he's a friend's son, maybe he'd be willing to take 1/2 the payment now, plus the other half on payday, plus the money to cover his returned deposit charge? I know it's embarrassing, but maybe it's better that it happened with someone you know than a company with whom you have no history.

            I certainly feel for you. Tunskit had some good advice as far as asking your son's friend if he wouldn't mind taking half the payment now and half in another week. Otherwise call your bank if you have a good report with them and explain your situation and ask them if there is anyway they could reverse some of the NSF fees. I embarassingly enough had to do this myself a couple of years ago due to one expense after another and somehow we had a huge miscalculation in our checking account which caused 9 overdraft fees at $35/piece!!! Thankfully the bank worked with us and waived all of them if we agreed to pay at least one. That's just an idea. Hang in there. We've all been in similar situations where you just feel overwhelmed but where there is a will there is a way.

              I have a question...when you write a check do you deduct it immediately from your check book so you are working with the correct balance? That could avoid the same mistake in the future and make sure your spouse is aware of the balance each morning before he leaves the house. Avoids a lot of headaches.

                Gee, so sorry you are going through this! I have a friend who is REALLY going through it on a 13 and she just does not know how she is going to survive this. She fears dismissal and is so worried about what all her creditors will do. She got behind on her mortgage as well because she had to Rob Peter to pay Paul, so to speak. All of a sudden, she was just able to let it go and just do what she can to catch up. Thankfully, her chapter 13 payment is not garnished, so she can wiggle a little with that but she says if the Trustee calls her on the carpet she will just show them all her receipts and tell them she just was not able to do anything different from what she did. If they dismiss it, so be it, she will just deal with it then.

                Anybody ever got dismissed and had creditors come after them?

                  Absolutely DO NOT take a payday loan. That is the kind of thing that puts people on the road to BK in the first place. It is not a way to get through rough times in a Chap 13. Better to owe the AC repairman money and pay him on pay day.

                      Ok.. Got a letter from atty asking for 2 month reprieve...trustee allowed one month, which is fine. This was done on the 2nd. Nothing shows on Pacer and trustee rec'd my June payment of $1215 on the first. So how do they do this? Tell my employer not to deduct two pay cycles or does trustee send me a check. If it's gonna be a PITA for my company's accounting dept it's not worth the hassle.

                        It sounds like you will have to make up any missed payment before the end of your plan. If a small inconvenience to your company makes it not worth it, then it sounds like you can do without the reprieve. You may want to forgo the reprieve if you have made it past the rough spot and would have to make up the payment before the end of the plan.

                            Thanks everyone. Guess my accounting dept got the memo because my paycheck this period is WHOLE!!!
                            And so will the next one!!! This gives me a little breathing room to catch up. Car tags due this month but compared to some of you they are cheap in alabama. $94 for an 08 accord and $130 for an 08 acura..but dog bills, hoa and AC repairs pretty much are taking it all.. But that's ok... At least I can breathe and maybe even get my wedding ring back out of pawn...sure makes me long for those full checks again!! Two years and they are mine, all mine!!
