    Can we still claim 19 year old college student on our schedule J

    Hello,

    Our daughter turned 19 and is a freshman in college. We are still supporting her and I was hoping we could still be able to claim her as a dependent when we do a new schedule J due to a wage increase. We only have 8 months to go!!

      Usually, college students are still claimed as dependents on their parent's returns. However, if she has worked and has to file a return of her own, she cannot claim the exemption on her own return.

        We could our lawyer said as long as we could claim her on our tax return she was a dependent

          In many cases, an adult child (dependent) that is attending college can be claimed as both a dependent for tax purposes, and as a household member and dependent for bankruptcy purposes. I did not need to provide proof, but the Trustee did ask when my dependent was going to be done with school. Of course I'm a comedian -- at least I think I'm one -- and I answered "isn't that the question every parent wants to know?". The Trustee and attorney giggled.

          If you are claiming the adult child as a dependent on your tax return, that will go a long way to proving that they are still dependent. These days, it is quite common for children to still be at home at 24 years of age!
