    Will be filing C7

    It's time for me to file C7. CC debt was the cause for me. I'm 31 and looking for a new start. Never thought I would ever have to do this, but I do and I will deal with it.

    You know what?? We are here for eachother. It's all going to be ok. None of us ever really "planned" on being in BK, so you aren't alone there. Use this board as much as you can. We are all here for you!

        Ditto, LakerHigh. I have never heard anyone who has actually done it say anything bad about bankruptcy. It sets you back a while, but I have yet to hear someone say it dosent do what it is supposed to do.

          Welcome LH!

          I never thought in a gazillion years that I would be here either. But finding this board and it's wonderful members has made things so much easier...to be forewarned is to be forearmed. You will learn a lot here if you do your homework and find that it is not as bad as you thought. Read all you can and vent all you need to.

          We'll get through this.

            Several CC's that I used in the past (over a year ago, some 3-5 years ago) went to collections, but I fought them with letters. I received an income execution from one creditor last week and tried to vacate it, but it would not be. I'm not working and the one job the income letter has posted, I only worked there for 3 weeks 2+ months ago. I never personally received a summons from that collector and if I did I would have answered like I did others. It's over now and the judgement they have is good. How did I miss that? I have no money as I write. I have no assets, no vehicle in my name. I reside with my mother. Times are tough, but I look forward to getting through C7. I have 5 CC's know that I do not use and pay the minimum payment on each (had to sell baseball figures, cards, etc.. to get the money). My attorney told me yesterday NOT to make payments anymore on those cards. If I did make any purchase on any of those cards it was for $20-$50 a couple months ago. The only large purchase was a Dell for $725 (on dell preferred account), 2 months ago. I bought this for a friend who had no credit and he has failed to make any payments for me. I have made the 1st two payments with the 3rd coming in a few weeks. Never trust anyone. What should I do about this? Thanks for all your help guys!!!

              As far as the bank is concerned you bought the computer, you are responsible for it and it will be discharged - most likely - in your bankruptcy. Dell might ask for it back but I doubt it. They might bluff you into thinking they are going to take it back but chances are they won't come and get it. If they do, send them to your friend's house to get it.

              As to the friend, I'd make him make the payments to you, at least the payments you already made.

              Welcome to the forum. Most of us didn't think we'd end up filling bankruptcy but thank goodness it exists to help us get a fresh start. The key is to make sure you don't over-charge ever again!

                  I will be meeting with my attorney Thursday afternoon. With the 2 classes I have to take (before C7 and after C7) plus the C7 fees and his fee, I'm at about $1400 after all is said and done. Does not seem that bad at all. He is also a trustee. Anyone know where I could find classes that I can take online, instead of going in person? I know they cost around $50 per. When this all ends.........

                    People on this board are GREAT and full of information. We took a class through start fresh alliance credit counseling. Our cost was included in our filing fees, so I can't help you on the cost of it, but it was relatively easy to get through and there is another one to take after your 341 hearing. We haven't filed yet, but are doing so in a couple of weeks. Best of luck to you.

                      Just for the record, if I were you, I would get the computer back from "my friend" right now. If he suddenly finds a way to pay you, then send that money to Dell. If he can not pay you, the trustee may request some action. You will have a debt on your petition with no corresponding asset. This could probably fly with a general credit card, but with an asset specific credit like Dell, it could be an issue. Or not! But I would want to have the asset in my possesion should it become an issue.

                      And please don't hang your head over having to file. Stand tall! If it makes it any easier to deal with, consider that the Bible itself sanctions the discharge of debt. Think "the year of jubilee". I am not suggesting that the bankruptcy is to be taken lightly. Quite the contrary. But do not beat yourself up over it. Use it as one of life's great teaching tools.

                        You will be smarter, stronger and more knowledgable going through this process. It is indeed an eye opener and kinda kick in the butt.

                        Like others, I NEVER saw myself heading to BK. One year ago I was sitting on a 720+ credit score but kept robbing peter to pay paul. My debt went from 15 to 30 days late. I still got them in ontime before it hit my credit and I was not living.

                        You will meet a lot of friends in here not for the 90 days it takes a BK but a lifetime knowing you are not alone. There are smart folks in here!

                          As for the Dell, I believe I will not get one cent from him. He has given me more stories. I do not have the funds for it. I made the first 2 payments and I can make a 3rd payment in a few weeks. I bought it in late December. If they will not discharge this (Dell), I will take care of it in the future on my own. Everything thing else should go well, I hope

                            BEFORE you take a pre-filing bankruptcy credit counseling class, be sure to confirm that agency's class is accepted in your state. You can find that out here - http://www.usdoj.gov/ust/eo/bapcpa/ccde/cc_approved.htm

                            Then AFTER you file, you can find out if the post-filing bankruptcy debt management class you have to take before discharge is accepted in your state here - http://www.usdoj.gov/ust/eo/bapcpa/ccde/de_approved.htm

                              Was with my Attorney today

                              Had a meeting with my attorney this afternoon and it went very well. Will be filing C7 in April. I'm very organized and have most everything I need or will need by the end of next week. Due to the fact that I'm in almost perfect order, he is taking off $200 (was $1000 fee) and I will owe him $800 + $299, so around $1100+ for everything. Now the sad part for me: I was given about 12 pages to fill out for him and to make it short and simple I have nothing in assets. I do not own a table, Tv, fork, spoon etc. You get my point. All I have is my clothing and watch along with some baseball cards. I reside with my mother (thank GOD for her) and everything is hers. We have a very nice place, but all thanks to her. I'm 31 with a Masters in SS and and AS in Marketing so things will change for the better. I just struggled with CC debt (my only debt) and I just had to stop the pain and file. This was all my fault, I'm to blame. I will be a better man cause of this. I feel better and will be better in time. I'm close to getting a very good job. I just wasted the past 5 years on odd jobs and thats how the story goes. Thank you all for your support. I will keep you posted in early April. Take Care
