The repo man just came pounding on my door at 3am

I surrendered my car in chap 7 after a failed attempt to redeem the car. I originally was going to take the car to a dealership and drop it of but decided instead to let them come and pick it up. Yesterday the finance company called me and left a message and I immediately, within 5 minutes, called back. The guy said they would like to make arrangements to come pick up the car and I said no problem. I told him that as long as I had
notice, I could take time off from work and it could be done during the day. He said okay and asked what number would be the best number for the tow truck driver to call so I gave him my cell. He said he would have the driver call me and make arrangements.

Forward to 3AM this morning. I wake up to my doorbell ringing and someone pounding on my door . I went and looked out a front window and I see the car on the back of a tow truck and at the same time I then hear my cell phone ringing. I go down stairs and grab the keys because I figure the guy wants the keys (I heard he gets more money for that) and of course I wasn't hiding the car so I open the door and hand him the keys and I say to him (in a low voice) this could have been done during the day. He said (very loudly) I AM JUST THE REPO MAN and I don't know anything about that. I said here are the keys and get the off my property and that he had no business waking me and my family up. He then proceeded to call me some not so nice names in his loudest voice again. This guy had to been given my cell phone number from the guy at the finance company.

Questions:
1.)I honestly don't care that they came and got the car but do they have a right to come ringing your doorbell, pounding on your door and calling you at 3am?

2.)I had the car cleaned out but didn't take the plate off the car due to our homeowner association rules and wasn't about to go outside at 3am this morning to remove it so, should I go get the plate (it is due to expire Sunday on my birthday 03.23)

3.)And can I now take the insurance off the vehicle??

Hopefully I can go back to sleep for a few hours before work after this adrenaline rush....

I don't know what that is, after I handed him the keys, I told him to get the hell off my property. I live in a townhome community and I didn't want his boisterous voice to wake up the neighborhood. He was being very loud and obnoxious and called me a *****.

A ride-through is when you decide not to reaffirm but keep the vehicle and continue to make monthly payments on it.

I wasn't going to but I didn't want him waking up my kids(they are heavy sleepers but he was being very loud), they sleep in the front of the house and their windows were open. I just wanted him to stop ringing my doorbell and pounding on the door and calling my cell phone. After he was a jacka$$ I wish I didn't but by they it was too late.

Thanks for the advice. I will call the DMV and will go onto my insurance website and approve the quote I submitted today for removal of the vehicle, which is going to save me over $100 per month.

He had a clipboard in his hand but I shut the door in his face after he started calling me names. I assumed he wanted me to sign something.

I tried to do the 722 redemption on it through chapter 7 and we couldn't agree to terms. The car was worth probably $12k on a good day and I owed $18k. Payments were almost $700 a month. I stopped paying when I filed in December. It wasn't worth keeping.

I am very sorry for your experience and you must be so frustrated that you were trying to do the right thing by arranging a time to do a pick up and they didn't honor that.

I think repo men pick up vehicles in the middle of the night because they get less confrontation from the car owners that way. I think generally speaking repo men would prefer to do their job during regular business hours but most cars to be repoed aren't sitting in people's driveways at that hour.

I was once engaged to someone who was vice president of a small local finance company and on the side it was his job to repo cars. I was always scared to death for him and he carried a gun. Car owners can get violent and their job is more dangerous than you realize. Yes, they should have called you ahead of time to make arrangements but they have many cars to repo that the information to get down the line to the repo guy to call first doesn't always happen. Maybe there were multiple cars to repo ahead of your's?

A couple of months ago my dh was pulling in from work at midnight and as he pulled into our driveway this huge truck pulls up a long side of him and just sat there. The windows were tinted so he couldn't make out who was in the truck but he knew it wasn't good. He thought he was about to get robbed.

The truck then drove very slowly down the street and turned around and as my dh got out of the car they drove very slowly passed him. Dh came into our house. I was in the livingroom not noticing what was going on. He looked out our livingroom window and then all of a sudden he ran out the door and I jumped up thinking wtf.

A big scary looking guy rolled down his window and asked if we were a certain address. My dh said no and pointed to our address plate on on our house and the driver said do you know where bla bla bla is and gave us a house number on our street that was actually our next door neighbor. My dh said I cannot help you and walked into our house. 5 minutes later we look out our window and they backed into our neighbor's driveway and open all the doors and take things out. We had already figured out this was a repo and I suggested calling our neighbor's to alert them to what was going on but my dh said no way. Our neighbor has a horrible temper and he flips out easily, especially at dog owners walking down our road who let their dogs go in his yard. He gets red faced and screams obscenities and waves a shovel at them. Dh was concerned that he would go out and flip out on the repo man and possibly get shot.

We never let the neighbors know what we saw out of respect to them. They had a silver SUV they bought last year that looks identical to our new SUV my dh bought 6 months go which is why the repo men were so interested in our car.

That repo man should not have called you names like that and again I am sorry for your experience.

I am sorry to hear you had to go threw that. That had to be horrible. Atleast it's gone. They can't come back. Just too bad he had to be so nasty. Sounds you were trying to be nice, and he probably hates his job, so he's an unhappy person. Just tell yourself soon all this will be behind you and you can go on with your life. Like me, I am sure you never intend to end up here again.

Repo's are up all over the country and there was a big article in our local paper a few weeks back on the entire subject. Most repo people are hired by the bank/lender of the vehicle to be repo'd and sometimes communication between both are not the greatest. The repo person's job is to get the car and not present sympathy cards to the present owner when they pick up the vehicle; however, they should not be obnoxious, although some people put them through hell just because of the job they do. The scenarios listed in the article were horrid to funny. Most people know the repo man is coming and its amicable; however, as stated in previous postings, some people just don't want to give up their vehicle and can get violent. Most work through the night because that is when vehicles/owners are home and vehicles available for repo. They may not know where you work to come get the vehicle there.

No one in any business should be derogatory to a customer, even the repo man. They get paid to do their work. They should be used to dealing with folks during the night hours but you can bet they bear their share of stuff from owners.

The article also listed that the job market for repo folks is now high due to the upserge in repos. It is not expected to go down soon...

I was asking a friend about repos the other day and he said they normally come in the wee hours of the morning like that.

I'd like to call them and tell them to take my car too, but if they don't make civilized arrangements, I suppose there is no point.

Thanks for the information! No I didn't get any paperwork. When he got nasty I shut the door and locked it and he continued on his tirade then went to his truck and left. I sent an email to my attorney. I wished I would have told him I would send the keys back to the finance company instead of handing them to him. I was just so taken aback that he was pounding on the door, ringing the doorbell and calling my cell phone.

Once I realized the car was on the back of the truck I knew what he was there for so I didn't even think twice. If he wasn't being so obnoxiously rude by pounding on the door and being very loud I would not have but he wouldn't stop. I was by no means surprised because I talked to the finance company yesterday and when he told me he would have the tow truck guy call me I assumed he would. Its okay though, it is gone! Hopefully my discharge will be soon and I can start rebuilding my credit and my life!
