    Nice call from a Paralegal

    Today we got a message from a Paralegal regarding out "case". (We haven't paid in 3 months) He is with CitiCards, and made a big deal about letting us know that he wants to speak with us today regarding our "case". We are planning on filing the end of Feb. (had to wait to establish residency and had activity) I don't imagine that they can do anything legally by that time, so I'm not worried.

    I was just wondering if anyone else had calls from a "Paralegal assigned to their case." before they filed, and if I should be worried.

    you mean do companies call and try to collect a debt?

    it doesnt matter who calls. attorney, para (supposed lol) or the trash man, its all the same. dont tell them you are going to file.

    just tell them you are trying to get it worked out and will contact them very soon with a plan. hang up the phone.

    they can file a civil case against you anytime. you can stop it by filing a bk petition. then take that to the civil court date if you get one.

    i had one move faster after they found out i was going to file. i regret telling any of them at all. no reason to imo.

      Stay off the phone! You don't have to talk to them. Correspond by mail only.

          What I'm saying is they should correspond by mail! Ignore phone calls, don't talk to them. It cannot accomplish anything.

            We haven't answered our phone the past three months- thus the message. The past week the calls suddenly dropped off- I have a feeling most of our accounts are heading to collections. I know better than telling them we are filing- thanks to this forum!

              OOOH! This was on the answering machine? If you wanted to put the time & effort into it, they would be toast! If they are a collection agency in any way, and most likely, they are, they can't leave those kind of messages for you!

                umm, they havnt filed bk yet so there is no stay order in effect.

                  Hello! BK has nothing to do with it. 3rd party collections are not allowed to leave detailed messages on an answering machine. Even commenting that the call is about 'their case' is a violation.

                      The guy stated that he was a Paralegal for CitiCards- he did leave our "case number" multiple times, though. Are the rules still the same if the call was from the original creditor?

                      Luckily this message was on our cell phone- we share a land line with my father, and haven't told him about the BK.

                            If he REALLY is a paralegal working for Citi, perhaps legal though I don't know what all they would say on an answering machine. If it was really being prepared for legal action, they would work by mail. If he is REALLY a collector then they are not supposed to leave any info on a machine, and certainly are not supposed to misrepresent themself as a paralegal. A 3rd party collector has very strict guidelines in place-I'm not sure about 1st party.

                              he left thet case number. hes allowed to leave that.
