    Florida?

    Anyone here file in Florida? We met with an attorney the other night. Felt pretty good about him. We asked if they could take away the money we would be saving from not paying our bills and he said no, they cant touch 12g of earned income. Anyone heard of this? we certainly wont have that much have nothing now, but probably will have at least 3g which we need to move and get a new place

    There are plenty of us here in Florida that have lived here and filed here, and others who have lived elsewhere and moved here and filed here. Then there are others who lived here and then moved elsewhere, and filed elsewhere.

    Now, please explain what your real questions are. Otherwise, we cannot help.

      I'm in Florida and going through the process now. When I say "going through" I mean that I have an attorney, have filled out the packet they gave me, and I stopped making my credit card payments. However, I am unable to file until the end of January, so that is where I'm at.

      As it is, yes, there are actually quite a few here that I have seen in Florida.
      Decided on Chapter 7: October 13, 2010; Retained Attorney: October 20, 2010; Filed Chapter 7: February 4, 2011; 341 Meeting: March 23, 2011; Discharged: May 24, 2011

          I'm not from Florida, but I've read that you can exempt 6 months of wages up to $500 per week... 6x(500x4)= 12,000. Might be what your attorney was talking about.

          Wages: 100% of paid and unpaid wages up to $500 per week for "head of household" (deposited into bank account for up to six months) [222.11] and

          6 month for non head of household mentioned in the document which is linked below. In re Weinshank 406 B.R. 413, (Bankr. S.D. Fla., 2009)

          Depending on income:

          WAGES:

          · Disposable earnings-head of family earning <= $500/week-100%

          · Disposable earnings-head of family earning > $500/week: greater of 75% or 30 X federal minimum wage

          · Disposable earnings: non-head of family: greater of 75% or 30 X federal minimum wage

          · Wages, travel expenses, or unemployment compensation payments under § 222.15 (travel expenses shall not exceed $300)

          · Unemployment Compensation Benefits - 100% except for support obligations

              there sure are....and PLEASE check your county in your district!! amounts for your exempt income CHANGE from one to another....but i know your atty will check lake cty for you....

              them mean average is above the $500 mentioned in many areas and less in others, so you everyone needs to be careful and find out what your county allows.

                Count me in, I filed in florida, I stupidly took out 6000 bucks from my 401 k , right b4 filing. I was okay with trustee. When she ask me , I see you took out 6000 from your 401, I said yes to pay my attorney and live on. She said okay. Of course I did not have home to claim exemption on. Do not take any money out until after filing...

                  yes...fg...we didn't have house to exempt either...and what lousy exemptions....shoot...what was it...like 1k each of personal property!!! awful!! i thought for a while we were going to have to pay the difference to keep our one LAST car....i brought in the kelly blue value and the trustee accepted it...thankfully!!

                      you should just be able to click on the site...or go up to the top of the bk forum screen

                      click on "community"
                      click on "groups"
                      click on "join"
                      then you'll see us...can't miss it...LOL!!! we are picture of the hurricane moving towards Florida!! a bk picnic...i really think we might do it! we could put a big sign up...ROFL!!!!!!!!!! anyone welcome!! we would most likely cause a traffic jam everywhere! everyone in fl would want to come to our picnic!

                              yes!!!! we are growing!! that's excellent...since i really believe there are so many of us. i saw your comment and i'm so tired of this credit profiling to determine how we drive our cars..it's really terrible!
