Received a collection letter from some attorney/collection agency for $23,xxx which really took me by surprise. I called and told them I filed and was discharged over a year ago and they said to get some papers together and send it to them. Shouldn't they be doing the research on their end? Do I need to worry about this or can I ignore it?

i wouldn't even bother and if they call you again i would tell them you will be turning their butts into the FTC and filing a complaint...tell them to repeat what you said and do not call again, unless they would like a nice big fat fine...and i would also mention i may give my atty a call and WE will be the one's suing you.Originally posted by PHXDWTN View PostReceived a collection letter from some attorney/collection agency for $23,xxx which really took me by surprise. Should they? Perhaps, however it's just not done. They're going to send you the 30 day letter and you're going to tell them that you have been discharged.Originally posted by PHXDWTN View PostShouldn't they be doing the research on their end? Do I need to worry about this or can I ignore it?
At this point, they should check your ssn on pacer, or your case # if you gave it to them.
They will mark it in their system, and then probably sell it to someone else. All information contained in this post is for informational and amusement purposes only.

As long as you've told them that you filed for BK, they shouldn't contact you again. I would give them the case number and refer them to your attorney that handled the BK if they have questions, but I wouldn't send them anything. If they do contact you again I would call up the atty that handled the BK and sue them! My atty actually did sue a creditor same situation, expect it was only within a couple months of me filing for BK.Originally posted by PHXDWTN View PostReceived a collection letter from some attorney/collection agency for $23,xxx which really took me by surprise. What do you sue for and what do you win when you win? There aren't any actual damages that I can see.
As for the attorney that did the BK...he has really turned into a very unhelpful individual after the BK. I had a question months after the BK and was told by his secretary that "We no longer represent you and if you would like to hire our services, we would be able to help you at that time." Nice service from someone who received $2000 to file the BK.
