    Just filed chapter 7 and won a jackpot at casino

    I just recently filed chapter 7 and afterwards I won 15k.. Will I have to surrender that to the trustee? I won a car and took the cash option of 15k. Anyone know the law on this. I will contact my attorney but curious what will happen

      Well you have to activate the e tickets the day of the lromotion.. but I did earn tickets before and after my date of filing. So I would not know when I actually earned the winning ticket. But.i could only activate them the day of whixh would be after the date of filing.. does that help?

        Doesn't really help because I do not know what an "Iromotion" is. Using the lottery as an example, if you purchased the winning ticket before the case was filed the ticket is an asset of the bk estate even if the drawing is post filing. Therefore the winnings belong to the Trustee.
        If the ticket was purchased after the bk was filed then the ticket is not an asset of the estate.

          Jti2002, did you use exemption system 1 or 2? If you used system 2, did you use all of your wildcard exemption? If the winnings are an asset of the BK estate, and you have remaining wildcard exemption, you can probably amend your petition to apply your remaining exemption to the winnings.

            Sorry I meant promotion.. I earned tickets thru the month of feb. while playing at the casino.. Received extra on Sunday and won the car Sunday.. I filed last thurs.. I do not know which ticket was the winner.. I had to activate all of them Sunday. If I didn't activated them then no chance in winning. So they became active Sunday night..
            I used up most of my exemption to protect the equity in my home. So I don't think I can use anything else.. Researching online some say since I won after I filed then it's mine to keep. It was not inheritance but basically winning at a drawing on Sunday.. Any comments on this? Waiting to hear back from attorney still.. I disclosed all my info during filing. This so happened to occur afterwards..

              As Des describes with the lottery example, the tickets you had on the date of filing were an asset of the BK estate as of the date of filing. Any winnings on those tickets is an asset of the BK estate. You may have to figure out which ticket was the winner. I bet the casino keeps track of that.
