    Car Repo - Can they withhold my stuff?

    Hoping you guys can help me out.

    I am planning to file BK in February when my taxes come back.

    My car was repossessed while I was in the middle of unloading groceries. I went back down to the car to grab the last bag as well my wallet and phone which were in the glove box but the car was gone. I was literally inside for 3 or 4 minutes putting the cold stuff into the refrigerator.

    I went to a friends house and called the police to make sure that it wasn't stolen because I am not that far behind on the payment. The police gave me the information of the towers. I called the towers and they are telling me that I have to pay some outrageous fee to get my things back.

    In the wallet is my cash, my debit card, my license an other id's. I bought two prepaid 30 day bus passes because I knew we would be letting the car go in a few weeks. They are in the wallet. I don't have enough cash to pay the fee that they are asking for. I called the nonemergency police again and they said that they do not get involved and that I can not report the items stolen because the towers did all of the legal steps in notifying the police of the repossession.

    I don't really care about losing the car or the last bag of groceries but I really need my wallet and phone. We are trapped in this house and my son's school is a 95 minute walk each way from the house. I don't have enough cash to get a buss pass. Everything I had was in the wallet. I work from home and need the phone for conference calls.

    Any ideas on how I can get my things back?

    That must have been very inconvenient and strange timing as you were going to step out and get your wallet and phone from your car. Is it possible if you can borrow some money from friends or family to pay for the fee (sorry this turned out to be an outrageous fee for you ) to get your personal items back? The repo guy at least should have informed you at the door he was here to repossess your car and to make sure your valuables were taken out of the car!

          Thanks for all of the advice guys!

          I called my attorney and he called the repo lot. They let me come pick up my things free of charge and even gave the plates back. Thanks so so so much for the advice because I wouldn't have thought to contact an attorney. I was considering payday loan and I know that wouldn't look good a few months before the bk.


          I was just about 45 days behind. I missed a June payment and then have been making the other monthly payments on time but I never paid back the June balance. I was 15 days late on the November payment. They are fast around here I guess. Also I think this this is a state where they don't have to notify you when they are here to take the car. They didn't ask for my keys or anything, and I didn't even hear the truck. I had no idea they were out there and they probably waited for me to get inside the house. It caught me off guard but it really is the bank's car anyway so I am not too sad.

          Anyway, thanks to you guys we got everything back, including the bag of food in the trunk.

            If I were you, I would write a letter to the Socal Scurity Inspector General notifying them your identity was taken from you without permission and state that your local police refused to do anyhng. Send a cpy to the police.

              I'd advise writing a letter but send it to the mayor and cc: The police chief, the publisher of the local paper and the dept of social security.

              Be sure to put that little cc box at the bottom so everyone realizes who got copies.
