    Our step daughter house was due for auction june it got cancelled along with bunch in Hillsborough county, so something is happening hearing or something end of august. She is going on 3 yrs in house since payment.

    Update from August 2012 2 3/4 year update. My last 2 posts are on page 9, explaining my lawsuit from 2009-2011.

    Suit filed against us 11/09, tampa area. Followed through on Ch7 bankruptcy at end of 8/2011, as final judement was going to be issued. Ch7 341 and following months were "easy". The trustee did not question or try to get the equity from our cash condo about 65k worth. We told trustee cash was from savings and wages and she never asked any further questions. Agreed to give back house owing about 325k.

    The funny thing is from 8/11 until now 8/12, nothing has appeared on the docket and as 5?? months ago the website docket has disappeared. There are no cases under my wifes or my name - where did it go???? There has been no communication between citimortgage, any lawyers, and us. Our son and friend continue to live in the house. We had hoa fees dismissed in bankrutcy, I am wondering if we are liable since 8/11 for new hoa fees. I assume bank has paid the yearly insurance, I havent got an insurance or citimortgage statement in 2+ years.

    Is it so bad in FL that banks are just abandoning cases to refile at a future time? Has anyone elses docket case disappeared from their local county website?

    August 2013 Update. 3 3/4 years now.
    Well here I am 1 year later and guess what has happened....nothing. Our chapter 7 assest case dismissed 12/11, but not closed by trustee until 5/13. Nothing from citimortage, courts, anybody within last year. This November it will be 4 years from Citimortgages initial filing. Our foreclosure case "disappered" off the county docket a while ago, nothing has ever reappared. Our son and friend continue to live there, there has been no upkeep done.
    If and when anything new transpires I will update. For those who say foreclosures are picking up speed, I dont see that at least in Tampa/St Pete. Tim.

    well for us still no word at all. lucky for us that nj has the only law in the country that once the lender sends out that summons of foreclosure and the owners leave the premises, the lenders become the sole responsible party for any charges affiliated with the property. we really think at this point chase will never foreclose as the property can no longer be repaired to any reasonable living condition. i'm certain 6 seasons of flooding out the inside of the house and the cracks in the foundation which spurted water out like it was a running waterfall has surely taken it's toll! the foundation must be mud by now. maybe it even fall down, who knows. at least ,thankfully it no longer is our worry!

    Update, We are still in the house, 3 yrs 4mos later. We found a new place and are moving slowly now. Hope the house sale will move forward fast now. We will see.

    BTW: Fannie Mae offered me 3k to be out in 30 days and 2k for 60. Also, had the option of renting while it was listed. Since I am almost out anyway I am taking the 3k.

    From what I have read if the case is dismissed due to lack of prosecution, then the bank has to start all over again and issue out a Lis Pendens. 12 months of no activity is supposed to make the case eligible for dismissal due to lack of prosecution. I was hoping for it to delay mine further but the lawyer responded in time.

    It looks like to me, The court is cleaning up their files and the attorney has not moved on the forclosure so they closed the file for now. A new attorney could open it back up.

    I wish I knew what was going on with my case. I received a letter 28th day of Jan 2013 Intend to dismiss for lack of prosecution. Sent out by the clerk of the court (Hernando County Florida) Plaintiff had 60 days to answer. Checked
    Docket as of 4/10/13 this is know what it shows... MOTION/NOTICE OF DISMISSAL. I assume Plaintiff attorneys did not answer. I have not received anything in mail concerning this. Banks lawyer is Marshall C. Watson. I read that he was suspended for 91 days and his law office was closed down. So is my case dismissed? I received nothing further in mail from the Court since the Jan 28th 2013 notice. Anyone know what happens next? Below is an example of my docket. XXXed out the names.

    Florida foreclosures are not really moving that fast. A report in a local Tampa Bay area paper listed Florida as number 1 in foreclosures in the last 3 moths. The article also commented that the Tampa Bay area had 3,900 foreclosure in that same three month period. Foreclosure are moving a little quicker for those already in the system for the last 2-5 years. Those just put in the system will still process through at about a 2 year years. A good lawyer, if your choose to fight the foreclosure, can drag it out even longer.

    Well, I hope the rumors of faster foreclosure in Florida are true.

    It's been nearly 6-7 years for us and we haven't fought anything or even answered anything.

    It would be nice to not have to think about it anymore, even though we haven't had a dollar's expense from it.

    I do feel bad for our former neighbors. Well some of them, the good ones.

    Looking forward to getting our check from the settlement soon though!

    Its a business decision, We had to make it, It is what is best for your family, not the darn banks.

    Anyway open the mail today , BOA sent a informational only advising us our house pmt is due May1, 1500.00 , ( We have not paid since 5-2010) Just in January they sent statement saying pmt was increased to 1746.00 . Do they really think we will be paying 1746, or 1500 for a house worth 80K. All our new neighbors are paying 500.00 for their 80K house. Sorry I had to rant.
