    question about deed

    I called the deed office where my house was foreclosed on and the lady told me my name came off the deed in the sheriff sale but when I look online there are 2 documents at 2 different dates.. It says under document type "sheriff deed" 04/2012 and then there is another one with document type "mortgage discharge" 08/2013........I'm guessing the mortgage discharge is when it came out of my name, any thoughts from anybody???

    I think it came out of your name on 4/2012. 8/2013 could be when they finally recorded a document to remove the lien. Or, it could be when the new owner paid off their mortgage. The only way to know for certain is to get copies of the documents.

      I know somebody bought the house in Aug 2013, like you said I'll have to get copies to know for sure.

        as long as the deed is out of your name you are fine. most counties in most states the information is on line and you can pull them up as PDFs and make your own copies. it is apparent by the description you state that the bank foreclosed and then resold your old home, that is exactly when the deed transfers and is recorded in the new owners name. also, if your mortgage was IIB the bank most likely then did the right thing and also indicated a cancellation of your mortgage, when that happened you should see on the document. you are lucky as far as what i have seen.

          So my 3 year clock started when the house was sold correct? I had to order them so it will be a couple of days before I get them.

            its hard to tell tigerman. was your mortgage a government backed loan? i ask this, is because although there are a few conventional lenders out there, they are far and few between. you must call and find out when your name was put on the caviars (no fish eggs involved here lol!)(800) 225-5342 list to find out when you would qualify again for anything government backed. ow that's not the direct number but i think they would be able to get it for you. the only i know able to get anything not backed on this forum was logan, another forum member. recently we just purchased another home, and i wanted to apply for a small amount for upgrades the amount was 30k and we were paying 100% down. i was slapped down by everyone, then of course after we closed i rec'd calls back from the exact lender telling me they have to wait until my caviars number is up is now offering me a mortgage. wonders never cease. so it's the luck of the draw as far as i'm concern.

            we had our bk 5 years ago, but no foreclosure still...according to the list we still have to wait until 2016. i don't have the phone number i called, but i think this number may be able to get you to the right place it's (800) 225-5342. that's FHA and they will be able to tell you how to get your caviars number now one would ask where the heck that got my count down date, well it was just simply arbitrary as chase may never foreclose, but we are on that all important list if we ever need it.

              It was a freddie mac loan, seems like I remember somebody posting a number you can call to see if you are on the caivrs.

                yes, make sure you do that...that is your clock per sa. i think i posted the number a bit ago, but can't find it just google freddie mac caviars) or call HUD, they will have it for sure.
