You know, we've had this same thread about a member needing to buy an a/c for her home where the tempuratures run nears 100 degrees. Then another just recently for a mom that needed to spend some money to make her home safe for hurrican season. I had the same opinion of those as I do on this. Do what you need to do and then IF something comes up you deal with it then. Reality is, she needs to buy it.

I think everyone is being a bit hard on her for a few hundred dollars in work clothes. I would have a different opinion on a flat screen or other luxury items.

When it comes down to reality, I think the benefit of purchasing the clothing out weighs the risk and consequences. And as far as the morality of it all, well, thats up to her to decide, but I know what I would do.

Maybe if you have stopped paying your cards to save up for a lawyer you can divert some of those funds for new clothes?

Personally I would go to the express and get what you need to keep your job!!!! If it is truly a need and you will not be able to keep your job if you don't do it then I don't see that you have choice!!

The worse case scenario is this; They object (highly unlikely if less than 500 or so) Then if they do object you can deal with it at that time and pay it back. It will not affect the rest of your bk.

Technically, by the letter of the law it is fraud, but again, do what you need to do to survive at this time. A job is the key to your survival right now and you know in your heart if this is truly a need or just a want.

          Sincerely,
I have to disagree. You just told her that you know it is fraud and to go ahead and do it. Sorry, but don't understand that thinking. You are telling someone that's it's okay to commit a crime.

I understand the dilemma that the OP has and do not believe that the worst case scenario is that the creditor objects. The worse case scenario is that her BK is dismissed.

But whatever. You have given her the answer that she wanted to hear. I just really hope it doesn't come back to bite her in the butt.

Sorry, you know, I forget the Express is now for guys and girls.....It used to be Stucture was for men and Express for women...then they changed both to express.

I don't think anyone is trying to be hard on the OP. Or speaking from morality. Just giving the facts. You are giving opinion, which is fine. Just hope the OP can differentiate between the two and come to a sensible decision.

Epi, I respect your opinion, of course and that of others

A bk will not be dismissed for buying a reasonable amount of clothing.

Look at majormike's posts on the AMEX for 5000 in gift cards as an example. Objection filed, but not dismissed. A case is dismissed if you lie on your documents or if there is substantial abuse....

I'm not saying its the best thing to do or whether is right morally or legally, but sometime you gotta do what you gotta do. How many time on this forum do people talk about charging food and gas after deciding to file. In this case, if it's the 100% truth, then this is not differnt that food or gas. The job puts the food on the table and gas in the car.

I can respectfully agree to disagree.

                      Epiphany,

I'm well aware of what is right and wrong...thanks again for explaining the facts. My main reason for the post was to see if anyone else out there was in a similar jam that I am in and if they had to make that type of decision and live with knowing it was wrong.

If you are uncomfortable with expressing in an open forum please feel free to private message me...I really would love to hear from some individuals.

Epiphany and Cindy, you both have been great btw...thx

Do I sound like I'm uncomfortable exressing myself in an open forum...jeesh must work on that...

Just to clarify, I was never speaking from a moral sense, farbeit from me to do that , only from the legal sense.

Wish the best of luck to you both on your new position and in your BK and um, yeah, your clothes shopping.

I risked blowing up a balance transfer of $10,000 from one cc to the next and just gambling it all with in several days. I had only made one below minimum payment on the $10,000. Than I file BK just above water (the 90 days), no objections no cry of fraud. But it was a risk and I was prepared for the consequences.

                                Just my 2 cents, Catchmeifyoucan
