I am hoping to file a ch 13, but I have so many concerns ! We are over the median income by 5/6k, I am separated though still married and cannot cover both the households expenses, my ex had an injury that prevented her from working and she needed my medical for her surgeries! We have no disposable income but we want to try and save the property. I do have a good job though with long term prospects. We are upside down on the property, no assets behind on the mortgage and property taxes, I owe the IRS and have 50/60k unsecured debt.
One of my questions is about timing.
I usually get a substantial tax refund is that included in our income calculation ?
I want to use it to pay back property taxes and catch up on the mortgage, should I do this before I file ?
I have one or two creditors getting pretty keen, I just got a letter from a law firm called Hunt and Henriques regarding a Citi account I have.
Any good attorney's in the Los Angeles area.
Any experience strength and hope would be appreciated.
