    Question Regarding timing ?

    I am hoping to file a ch 13, but I have so many concerns ! We are over the median income by 5/6k, I am separated though still married and cannot cover both the households expenses, my ex had an injury that prevented her from working and she needed my medical for her surgeries! We have no disposable income but we want to try and save the property. I do have a good job though with long term prospects. We are upside down on the property, no assets behind on the mortgage and property taxes, I owe the IRS and have 50/60k unsecured debt.
    One of my questions is about timing.
    I usually get a substantial tax refund is that included in our income calculation ?
    I want to use it to pay back property taxes and catch up on the mortgage, should I do this before I file ?
    I have one or two creditors getting pretty keen, I just got a letter from a law firm called Hunt and Henriques regarding a Citi account I have.
    Any good attorney's in the Los Angeles area.
    Any experience strength and hope would be appreciated.

    The Income tax refund would be an asset. If it is substantial you'll want to be able to prove you spent it towards allowed expenses.

    Back property taxes and mortgage are of course allowed expenses and yes you should do this before you file.

    Probably they are just trying to scare you into paying, that's their goal. It would take much longer to actually get you into court. They'd have to have official papers served to you by authorized agency of your city/state. You'd then have time to respond (my response was to file ) and even after that they'd have to go after garnishment to get the money which takes more time.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

        If I am not mistaken , Hunt and Henriques is a Junk Debt Buyer/Lawfirm, basically a CA that uses a lawfirm's name to scare the debtors.

        I remember a few years ago I had a collection account that kept getting "bought" by various CA, and H&H would send stupid , semi intimidating letters, I ignored them and nothing ever happened.

        Google them and see what you find out.
