Trustee request for bank statements

Do trustees commonly ask for copies of your checking account?

It is a common request yes.

As stated, yes they do. It's very common in a Chapter 7, and in fact, is required by the majority of Trustees. The reason is usually that they want to know what your account activity was in the last 90 days and they are looking to see if you withdraw or received large amounts of money. If they see large transactions -- don't ask me what constitutes a "large" transaction -- they may ask more questions at the 341 Meeting or followup after the 341 Meeting if there is something concerning them.

The Trustee also wants to know what was in your bank on the DAY that you filed. There are Trustees who find a LOT of money this way.

Is 90 days essentially it, or do some of them go back farther than that?

They can go back further if your case warrants such. The Trustee will tell you what they want.

when we submitted our petition we were asked to supply 6 months worth of statements.

i asked my atty what to bring to the 341...he said nothing....but for me, i brought everything but the kitchen sink to make certain if i was asked for anything i would have it at our fingertips. (Oh...wait..i also did bring the sink it was heavy!).

i have heard it goes both ways on this forum. some were asked and sat and watched all the 341 prior to theirs being called up and it was the same thing...asked for past statements.

we were asked for absolutely NOTHING....however, we were the first one's called so i have no idea if anyone else was asked to produce anything. actually, most everyone else sitting in that room came empty handed.

now that i have read more on this forum, i'm thinking that maybe this particular morning this particular trustee had "clearly" no asset distribution cases....by the looks at how poor we all looked!! i was the only one with a type of "briefcase".

When we submitted our petition they didn't want bank statements, I asked. As well when we went to the 341, they didn't ask for anything.

really??? justfive...we had to submit 6 months.

it may vary from state to state and then district to distict...no quessing at this!

We had to provide 90 days worth of pay stubs and our tax returns. We live on pretty much a shell of a budget so there's not a huge question if we were out spending $$ on big ticket items that we may have omitted so maybe that's why... I have no idea.

yes, it's odd how it changes as to what is required to file...from state to state...district to district. who know what their thinking is.

my trustee asked for 6 months, but I only had 5 due to a checking acct being closed due to being overdrawn
