    Job before 341

    I know this post has been written a hundred times by a hundred people. But I'm stressing and need reassurance.
    I will meet the means test as of October 1st and that's the date that I'm scheduled to sign papers and hopefully everything will be turned into the court.
    Problem. I have an interview tomorrow and I have an interview on October 1st. Both are for part time positions. So I think I would be ok for the means test, although it might be close.
    I talked to my attorney today regarding my interview, and my attorney recommends I don't get a job until after my 341 meeting.
    I don't have enough money to hold out until after my 341 meeting. I need a job like yesterday. I'm not sure how I'm even going pay this months bills.
    The attorney said since I have very little expenses that it would be hard to qualify me for a 7 if I had any type of job. Only reason I don't have expenses is because I'm staying with a friend until I get a job and get back on my feet.
    Should I wait to get a job? Do I get a job and risk the trustee forcing a 13?

    If you file on October 1st, a job that you may get after October 1st should have no bearing on your case because your eligibility for a Chap 7 discharge is based on the facts as they exist on the date you file.

    I'm not an attorney, so I don't want you to count on what I tell you over the advice of an attorney. But every time I have read of a bkforum member telling a trustee at a 341 that they just got a new job, the response is "congratulations and good luck." I suggest you consult with a different attorney.

        There is a Chapter 13 Bankruptcy for those who are unemployed. I hope you were able to get those part time positions. It’s better if you ask for a second opinion from the experts.
