    Early Payoff Progress

    I am in month 53 of a 60 month plan. I got approval to refinance my mortgage and pay the plan off early, got refinanced and handed in the final plan payoff check to the trustee's office on 09-23. I finally see the light at the end of the tunnel and it is NOT the oncoming train! My wage order stopped this week and the Ch 13 Trustee's website finally shows the case status as "Close Pending - Paid Out" and the final payments to the creditors and the refund to me for the extra wage order payments since payoff should be going out tomorrow. I got the "Congratulations" letter from the trustee in the mail today. It looks like this horrible thing is finally over!

      Quick question - was your 13 filed before or after October 18, 2005?

      I'm asking because if you filed after October 18, 2005, then you will be our first 13er who has been able to pay out of their 13 early and not have to pay their creditors 100%.

      So.....when did you file? Under the old bk law or under the current bk law?

      06/28/06 - 341 Meeting
      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

        It would appear the OP filed under the old law as he states he is 53 months into a 60 month plan. The new law came into effect 48 months ago this month. So he would be eligible to buy out early.

                I too am interested to be sure OverThisCh13 is an "old law" case. I haven't seen a new law (BAPCPA) case with an early buyout for less than 100% to the allowed unsecured claims.
