Stimulus rebate / tax refund - What happens to it in bankruptcy?

    I emailed my attorney last week and asked if we can keep it or do we have to turn it in


    nothing, dead air. no response, no answer, nothing at all!

    We're still waiting for our direct deposit and my DH's last 2 digits are 12.

    I didn't think to ask our lawyer if we should save it in case the trustee wanted it since the whole stimulus deal finalized AFTER our 341 on Feb 5 and we are a no asset CH 7. In fact, I just talked to his assistant this morning because we are still waiting to be discharged and closed.

    Now I'm wondering if I should ask....

    My SO has not filed at all and his last 2 digits are 01 so I think that it is okay. I would not be too concerned this early.

    my last two are 19 and we have NOT received our rebate if anyone is interested in knowing that information so i don't know if they just didn't get to ours yet or the trustee intervened and took it.

    i talked to someone else on the 13 cat and was told by that person that they didn't file their bankruptcy yet and their number was 09 and have not gotten it yet either so maybe that's a good sign and the trustee didn't take it

    Right after I typed my last post I checked my email and there was a message from my attorney's legal assistant saying that they had just heard from the trustee's office this a.m. and he now says he will not be taking any of the rebates for cases filed before February 15, 2008. We filed August, 2007. YEAH!!! We get to keep our check!!! However I will not be stimulating the economy with this money. I will be depositing it into our savings account for any upcoming, unforeseen emergencies. If it's one thing I've learned from all of this it is to have a savings account so that hopefully I will never be in this situation again.

    that is awful. it's too bad that the trustees have incentive to take the rebates (they get a percentage of every dime they take from us).

    I'm in central IL and just found out this a.m. that my trustee is going after everyone's rebate who is in a ch. 13. My attorney is trying to negotiate with him to just take 50% but at this point in the game it is not sounding too good for me. I'll keep everyone updated.

    We got a letter awhile ago. I know of several people that have received their stimulus checks and some had higher last 2 digits.

    We are discharged Chapter 13 (discharged 8/06) and received our refund over a month ago from the IRS which was auto deposited into our checking account. We filed jointly and my hubby's last 2 digits are "09" on his SS. We are entitled to and expect a $1200 rebate and as of this morning, it has not yet been deposited into our checking. So those of you in BK who have the low ending two digit SS number, don't think your trustee has taken it yet if it is not there and you expect auto deposit....

    My sister got hers, she is 02. I am 06, so I should be getting mine soon.

    I didn't get one, but my dh's digits are 92 and mine are 98....SOOO...I think we are at the end of the list.

    I was told that two of the trustees are keeping them and one is not..My last of my social is 01..and I just filed on thursday:-( ps im in florida.
