field services came to our home and changed locks, locked us out. they were supposed to "secure" the home and winterize. they did not do it all right and we now have no heating in our home due to their negligence.
i asked the bank the name of the company they use and was told that is confidential information. WTF???

I think that there is definitely something shady gong on! This guy that was in your house should be in handcuffs.

Exactly - just prior to filing I received a letter from the bank stating they were turning my account over to the foreclosure department and they had the 'right' to come into and inspect my house. BUT - there was no mention of doing it without my being there. Also, how in the world did they get in? I know that after I had some remodeling work done I changed the locks so how could someone get in unless they broke in?

He claims he's supposed to come in and take photos if it looks vacant.

This was my business line of credit and NOT my mortgage.

    Assistance Anyone???
Next time call the cops while the intruder is still there and report a break in. The bank does not have the right to have someone enter the home that they do not own. And until your name is off the deed, you are the owner and not the bank. That person broke the law.

I've also put a permanent freeze on all our credit files too. A good idea IMHO given how little use we have for credit now.

One thing I've discovered since filing BK is that your name, address, and everything else included in the BK paperwork is public knowledge and can be accessed with anyone who has a PACER account. I'm getting junk mail nearly daily about my BK, and how all these people can 'help' me. Anyone can find out who your mortgage company is by looking it up on PACER. Maybe the guy is legit and just terribly aggressive, but he was in the wrong. Beware and be assertive. Wishing you well.

I have a german sheppard who makes regular german sheppards look small. If someone came into my house when I wasn't there they would be lunch or toast, you pick! The UPS delivery guy knows.

There is no legal reason for unauthorized entrance to private property. There are two exceptions, fire or other emergency to protect life and property, or by a legal order to vacate and this means even if the house has been sold, yet a Judgment to vacate has not yet been issued.

Did you see a camera of that person? Did you get a tag number? Did you ask what bank or company authorized him to take pictures? I like others feel he was there and used an excuse to case the place. Watch out for a theft. If it were I, and I have done this, I would park away, keep the lights off, and wait for a break in with Smith and Wesson by my side. 'Hub
