Forum Rules (Everyone Must Read!!!) (updated: 04/28/2015)

Welcome to the Bankruptcy Forum. Bankruptcy (BK) Forum is known as BKForum.com and will be referred to as BKF hereinafter. In order to ensure a long term success of our vibrant community, we have established certain rules and guidelines to which everyone must adhere to. Please take your time to carefully read our rules, before you start to participate in the community.

Things you agree to do:
BKFORUM.com (BKF) users agree to use the search function before starting a new thread. This prevents duplicate discussions and allows for better organized topics.

All BKF users agree to read the sticky posts which may be available at the top of a forum page. These Sticky posts often contain valuable information. They may also outline more rules and guidelines specific for that particular forum, stickies are put in place by that forums moderator(s) or admin(s).

Things you agree not to do:

All BKF users agree not to call people names or write a post simply to make a personal attack, or get a negative reaction; this behavior is not allowed on our forum. The use of derogatory language aimed at anyone will be severely dealt with. There is no need to agree with each other, or to even like each other. However, by signing onto BKForum.com you agree to treat each member and guest with the respect they deserve. No threats or personal attacks will be allowed.

All BKF users agree not to discuss, engage, or encourage any behavior or activity which violates the law. Discussion of drugs, violence, murder, theft, vandalism, fraud or any other issue which could be used to help individuals break the law is strictly forbidden.

All BKF users agree not to "bump" old threads, unless there is a specific benefit to the community by doing so. But in most cases, please don't post in very old threads, instead start new threads.

All BKF users agree not to attempt/use another members account. It is against BKF rules to use any account other than your own. Impersonating another member will result in an immediate ban. It is also against the rules to open more than one account in your own name without permission from a moderator or administrator. If you have been banned for any reason, it is against the rules to open another account. If you were banned temporarily and you are caught using another account you will be banned permanently. Choosing a moniker which is similar in either sound or spelling as a moderator or administrator is strictly forbidden.

All BKF users agree not to private message any moderator, admin, or other member with questions related to their personal circumstances (Questions about the forum or issues with the forum are ok). This forum only works when members share their experience and insights with everyone.

Things you agree not to post:
All BKF users agree not to post any derogatory/racist/or sexist remarks. This includes attachments, links and all information contained within posts, signatures, and avatars, failure to comply with this rule will result in a permanent ban.

All BKF users agree not to post any copyrighted or trademarked information without the express written permission of the owner(s) / proper citation of source.

All BKF users agree not to post any real names, addresses, telephone numbers, email addresses, social security numbers, or any other personal details (their own or other people's).

All BKF users agree not to post links, pictures, attachments, videos, or the like of pornographic content, objectionable material or extreme violence, whether cartoon or real.

All BKF users agree not to use BKF for advertising purposes without a written contract between yourself/company/agent and the administration of BKF. Blatant advertising will result in a ban.

All BKF users agree not to spam the forums. Spam includes but is not limited to posting erroneous, non-relevant-useless, off-topic, or meaningless posts. Spam may also include posts which contain no text, or large areas of blank space between lines. Simply posting emoticons without text is considered spam. BKF is the largest bankruptcy message board and all the content is intended to help other users. Please help us improve the quality of our forum by making sure that your posts are well-worded, spell checked, grammatically correct and syntaxed.

Regarding actions of moderators and administrators:

The forum is no place to air out your opinion or be judgmental of our staff and its capabilities.

All BKF users agree not to abuse or mistreat moderators or administrators. It is against BKF rules to post any information regarding bans or any other action taken by a member of the moderating or administrative team. If you wish to discuss bans or warnings please do so via PM. To place a complaint against a moderator, send a PM to a super moderator. All Moderators are equal, any decision made by a moderator must be adhered to. If a moderator tells you something you do not like, do not go to another moderator looking for a different answer. If you are caught doing this you will be banned. The moderators work as a team and respect the decisions made by their peers and will help enforce them unless an administrator tells them differently.
If you have an issue with how the forum is run, then notify one of our administrator and we will look into the situation. We have in the past and still do appreciate any input that you offer this forum. But critical input and/or judgmental postings towards the staff will result in you getting banned.


Should you find a thread offensive or out of line, then notify a Mod in a PM so they can evaluate the situation and do the action deemed necessary.

All moderators do have active "other" lives outside of the forum and help moderate this forum in their spare time throughout the days and weeks.

If you have a problem with a member or Mod follow the proper channels of reporting it.

BKF reserves the right to delete any posts which contain anti-BKF comments or discussion. Any bashing of moderators or administrators, or any of their discussion or actions will also be deleted, and the responsible posting party(s) will be banned. Any public anti-BKF advertising, communication, or posts on another forum will result in permanent bans as well.

All warnings and bans are decided by individual moderators and administrators. Warnings are preferable to bans however, for serious offenses and repeat abusers bans will go into effect. The length of the bans can vary from several hours to permanent.

All messages posted or sent including through PM are the property of BKforum.com.

All BKF users agree not to advertiser on the forum (Niether by posting, private messaging or using your signature). If you are a company/attorney/legal adviser wishing to advertise on the site or sell a product, you must contact the head administrator and inquire about our advertising packages.

All bankruptcy related opinions expressed on BKForum.com are those of their authors and not necessarily of BKF, its staff or representatives.

  • Tips for Making the Dreaded 341 Trip?

    So it is impossible to do telephonic 341. We HAVE to show up in person to give our ID.

    You can get credit cards, student loans, home mortgages, anything, without being in person. But not this.

    So, 8 people, a disabled person in a wheelchair, little children, and a baby in -25 degrees, with no winter gear, traveling about 20 days or so, depending on how fast we can get through the snow.

    Everyone online says this is an easy trip for anyone. If we do not do it, we are "lazy" and "do not deserve bankruptcy".

    The news says you begin to lose body parts in 5 minutes. So... any advice on how to survive the trip? I know it seems easy to you guys, but I have no clue. That is why I am here.

    If there is no public transportation and you don't have friends or family members to help with childcare and/or transportation, it sounds to me like you need to get in touch with social services or a church or other charity to help you out. How do you get to the grocery store?

      The grocery store is only 2 blocks away. That is why we live here. But it does not take 9 days to go two blocks. And I am not required to bring my entire family.

          The 341 meeting can be an imposition for some but it's an important part of your bankruptcy that you need to find a way to attend.

          Like others on this threads, we're not understanding some of the issues you mention as being in your way of attending the meeting so maybe you can help us better understand the issues and we can better provide suggestions.

          - You mention needing to travel to your 341 with 8 people. Why do all of these people need to go with you? Is noone available to keep an eye on sick, disabled or young family members during the time needed to attend the meeting?

          - You mention needing to walk for 20 days in the cold weather and snow. How far away do you live from where your 341 meeting will be held and do you not have any options for transportation? A car? A neighbor who can drive you? Buses? A Taxi? Uber?

          The people on this site are here to help but part of bankruptcy is having to go through some hoops and being willing to do some uncomfortable things in order to give yourself a chance at a fresh start. Based on your initial post it seems like you are trying to find excuses as to why you can't do what's needed to go through the process, so please help us to better understand why you are having these issues and we will be better able to provide assistance.

              The disabled person is required to go. And the one who watches the kids is required to go. Besides, we could never be away from our kids for a month! They could not handle that. And the baby needs to eat.

              We live 800 miles from the court house.

              I have thought about hitch-hiking. But with all the kids, and no car seats, it does not sound likely. Not to mention hitch-hiking is illegal now. I have not asked neighbors, but is that a normal thing to do? I mean, I suppose one MIGHT be willing, if I could fork up a bunch of cash. But then there would be an issue. No car(even if I were so wealthy, I cannot drive), no bus, no uber, no taxi, no plane, no train, not even a rickshaw...

              Any ideas?

              I am trying. I am posting on websites, and calling all kinds of people. This is all very stressful. This sort of thing has me in tears at night when the kids are asleep...

                Because the children cannot be left alone for a month. They need to eat and not kill themselves. And not to mention, emotionally, that would traumatize them.

                  There are options available. First though, take a breathe. I'm reading full out terrorized panic in your numerous posts. Many of us have been there, even managing to have escaped from an active terrorist situation, or the ones in there doing their best to contain said terrorists only to come home to a financial mess. Get through the emotional part as fast as you can, even if it means going outside for under five minutes at a time and screaming or cussing out the excess emotional energy. This too will pass.

                  There is no debtors prison. It can take a long time to be evicted. So go through your checklist, housing, water, food. There are foodbanks that can help, Medicare and Medi-Cal or Obamacare for the health issues and healthy baby. You are safe now.

                  Now it's time to pursue the options for the hardship and waivers. Call and write Social Security. Explain the hardship the offset has caused and ask for a waiver or significantly reduced offset. Don't get success with the first person, ask for their supervisor. Look at is as a game to help keep the emotions out as much as possible. Make payment arrangements for everyone else as well, even if it is $2 a month to each creditor.the creditors don't have to accept it, it doesn't matter, they are getting paid. And if they sue you, so what, what are they going to do, garnish 25% of nothing as they cannot touch Social Security (except Social Security themselves, IRS, Alimony, and child support)?

                  And spend some time on the phone. Ask attorneys during their free consultations if you can reduce the burden on filing. Some courts will allow telephonic 341 meetings if your attorney can verify it is your voice. Some courts will allow you to file across state lines using the appropriate exemptions. The only way you will know is by asking local attorneys.

                  get some of the other household members to help. Kids and adults, bundled up, can shovel snow, code apps, do small or large tasks through sites like Fiverr and Guru, or generally make themselves useful after homework. If the kids (or yourself!) can learn to code, earnings can be unlimited. Learning can take awhile so it is not an immediate fix, but it is a future.

                  Read through Dave Ramsey's website, he covers the emotions of financial problems very well. And do please let the defensiveness go. Some members on here are doing their best to assist everyone, no matter how the person arrived at their situation. Best of luck to you.

                    Thank you for your kind words and good advice. We were thankful to be back... in America, where we are supposed to be safe. Seems like things are getting harder here though. We are finally "on our feet". We have food and a real place to sleep at night. That is why I thought it was time to get other business done. I have finally made contact with legal aid. So we will see if that gets us anywhere. Thank you again.
