    Chase Calls afte Four Years??

interesting, about 5:30 yesterday i rec'd a phone call from chase in reference to the house we surrendered to them over four years ago.

first, the guy says very nicely, this is NOT an attempt to collection a bill, then read me some legal disclaimers etc.

then he asks what we intended to do with the property. LOL!! i asked him, with all due respect, what is it about the word "surrender" chase didn't understand. he then asked if our position had changed? i asked him changed from what...it's four years later we don't live in the state any longer. he said well he wanted us to know that they are foreclosing on the property. i replied, well, it is about time! what has taken you so long?

we then asked why we filed bk....what???? then he asked to verify my phone number, i said, didn't you call me? then he asked me to verify the property location, i told him i'm certain he knows it.

i had no idea where he was going other than i do believe that they were looking to see if we wanted to the house back...had i not just woken up from a nap i would have been a bit sharper. darn!

Yes, this is certainly a strange call. I too would have offered no details since I could not verify who the person is that called me. Generally speaking, I don't verify information for ANYONE that called me directly without me asking them to call me.

(I fixed the double thread problem.)

Tobee, this should be fun to watch and see what they do and are up to. Maybe you will finally get this elephant totally off your back. Keep us posted, I think you are the longest one so far that I have seen waiting for the foreclosure to happen.(although I am sure there are plenty more that are around that timeline)

Sounds fraudulent to me - be careful as someone has your phone number and is looking for information. Did you ask to verify who he was and get a return phone number to call Chase to verify the call? Always do that when something like this occurs.

i knew better and didn't do a thing!!! one would THINK i would be prepared like a parrot, no way, i was deep in nap and totally unprepared, however, did not give out any information about our number or the address of the house. the caller id has it has unknown caller, interesting it didn't' say Chase right?

jb...yes, who would verify your phone number when they just called you??? so i was figuring it was be dial a deal...he had our full names but still asked about the property address (which i did not provide). i just want to KICK myself! thanks for fixing my double thread

panda, i will keep you posted, but i doubt it very much that i will hear from anyone again for at least another 4 more years. too weird.

That is really weird tobee... be ready next time - no more naps for you.

I'm always interested in your case because we're about 1 year behind you (waiting for foreclosure for 3 years now). We've called BofA a few times and they just say "we'll get to it when we get to it".

These banks make no sense. By refusing to foreclose, it seems they are hurting the economy and themselves even more. I've seen several posts on this forum about people that are 2+ years after discharge and could get another house thus emptying some of the bank owned inventory, but the 3 year foreclosure clock on their old property hasn't even started yet. We're in that very same situation. We've saved 30% for a down payment and the mortgage payment would be less than our rent, but without the foreclosure even starting (let alone being finished) what can we do? If this keeps up much longer we'll probably just save for a few more years and pay cash.

i so hear you! that's why we went the owner finance route (OK hhm i know many can't do that!) however, it worked for us. we by passed the banks completely and had a rather large down payment...i WILL pay off this mortgage within the next 36 months i swear.

and yes, karm, it is freaky!!!!...and scary LOL! just a bit. however, i'm not scare of the boogyman at all, or for that matter the monster under the bed, too bad for them LOL!!!

Tobee, that is strange. Maybe they'll finally foreclose and end that chapter for you. So that house has been vacant for four years? Who pays utilities, anyone?

For everybody who has been waiting 2+ years after BK for the house to forclose, did you ever hear anything from the bank or their lawyers, ie, certified letters, etc or did they just stay silent?

i hope so, i really do, but as flamingo and others indicated it may not even have been a "real" call. yes!! the house has been vacate for over 4 years now.

we did notify them when we left. actually we were right in the middle of trying over a year to do a loan mod, when we were served and given 30 days to answer the summons or they said they were foreclosing. since we were jobless, had over 200k worth or medical bills after 30 years we decided as per our atty, just not to answer the summons and vacate if that is what we would like to do, since we couldn't even afford the utilities any longer ,we thought it best to leave.

we shut off all the utilities, cleared the pipes, notified the bank and they had changed the locks within a week or two. they have been maintaining the property from what we have heard, paying the taxes etc.

we tried to do a DIL, we were successful with one on another property we owned, but chase would have no part of it. we have PMI and it was an FHA so it's government backed and i checked with the FHA and they said no claim has ever been filed by chase on that property even though it is a government backed loan. to collect from the FHA they must foreclose first and attempt to get some monies back and then collect on the remainder. but nothing, not a thing. they know where we are, because the first year we did get a 1098 for the taxes and interest we paid that year. they know where to find us.

In our case, the last "foreclosure talk" was in October 2009. We received a letter stating their intent to accelerate and foreclosure would begin in Nov (2009) if we didn't bring the loan current. So.... 2 1/2 years later... nothing and they say "we'll get to it when we get to it" when we call them. We do still receive the monthly statement and every spring we get the "you must purchase insurance or we'll add our insurance to the mortgage" letter from BofA.

we never rec'd any monthly statements at all after we left, not a one. also we were not allowed in the state of nj to purchase insurance unless we lived in the house. we tried. however, chase just put the house under their umbrella policy. now since the mortgage was discharged with our bk, i am really not caring if they really ever foreclose (only because we already purchased this house) but for those looking into the future to get a mortgage, these delays are ridicules in the foreclosure process.
