Forum Rules (Everyone Must Read!!!) (updated: 04/28/2015)

Welcome to the Bankruptcy Forum. Bankruptcy (BK) Forum is known as and will be referred to as BKF hereinafter. In order to ensure a long term success of our vibrant community, we have established certain rules and guidelines to which everyone must adhere to. Please take your time to carefully read our rules, before you start to participate in the community.

Things you agree to do: (BKF) users agree to use the search function before starting a new thread. This prevents duplicate discussions and allows for better organized topics.

All BKF users agree to read the sticky posts which may be available at the top of a forum page. These Sticky posts often contain valuable information. They may also outline more rules and guidelines specific for that particular forum, stickies are put in place by that forums moderator(s) or admin(s).

Things you agree not to do:

All BKF users agree not to call people names or write a post simply to make a personal attack, or get a negative reaction; this behavior is not allowed on our forum. The use of derogatory language aimed at anyone will be severely dealt with. There is no need to agree with each other, or to even like each other. However, by signing onto you agree to treat each member and guest with the respect they deserve. No threats or personal attacks will be allowed.

All BKF users agree not to discuss, engage, or encourage any behavior or activity which violates the law. Discussion of drugs, violence, murder, theft, vandalism, fraud or any other issue which could be used to help individuals break the law is strictly forbidden.

All BKF users agree not to "bump" old threads, unless there is a specific benefit to the community by doing so. But in most cases, please don't post in very old threads, instead start new threads.

All BKF users agree not to attempt/use another members account. It is against BKF rules to use any account other than your own. Impersonating another member will result in an immediate ban. It is also against the rules to open more than one account in your own name without permission from a moderator or administrator. If you have been banned for any reason, it is against the rules to open another account. If you were banned temporarily and you are caught using another account you will be banned permanently. Choosing a moniker which is similar in either sound or spelling as a moderator or administrator is strictly forbidden.

All BKF users agree not to private message any moderator, admin, or other member with questions related to their personal circumstances (Questions about the forum or issues with the forum are ok). This forum only works when members share their experience and insights with everyone.

Things you agree not to post:
All BKF users agree not to post any derogatory/racist/or sexist remarks. This includes attachments, links and all information contained within posts, signatures, and avatars, failure to comply with this rule will result in a permanent ban.

All BKF users agree not to post any copyrighted or trademarked information without the express written permission of the owner(s) / proper citation of source.

All BKF users agree not to post any real names, addresses, telephone numbers, email addresses, social security numbers, or any other personal details (their own or other people's).

All BKF users agree not to post links, pictures, attachments, videos, or the like of pornographic content, objectionable material or extreme violence, whether cartoon or real.

All BKF users agree not to use BKF for advertising purposes without a written contract between yourself/company/agent and the administration of BKF. Blatant advertising will result in a ban.

All BKF users agree not to spam the forums. Spam includes but is not limited to posting erroneous, non-relevant-useless, off-topic, or meaningless posts. Spam may also include posts which contain no text, or large areas of blank space between lines. Simply posting emoticons without text is considered spam. BKF is the largest bankruptcy message board and all the content is intended to help other users. Please help us improve the quality of our forum by making sure that your posts are well-worded, spell checked, grammatically correct and syntaxed.

Regarding actions of moderators and administrators:

The forum is no place to air out your opinion or be judgmental of our staff and its capabilities.

All BKF users agree not to abuse or mistreat moderators or administrators. It is against BKF rules to post any information regarding bans or any other action taken by a member of the moderating or administrative team. If you wish to discuss bans or warnings please do so via PM. To place a complaint against a moderator, send a PM to a super moderator. All Moderators are equal, any decision made by a moderator must be adhered to. If a moderator tells you something you do not like, do not go to another moderator looking for a different answer. If you are caught doing this you will be banned. The moderators work as a team and respect the decisions made by their peers and will help enforce them unless an administrator tells them differently.
If you have an issue with how the forum is run, then notify one of our administrator and we will look into the situation. We have in the past and still do appreciate any input that you offer this forum. But critical input and/or judgmental postings towards the staff will result in you getting banned.

Should you find a thread offensive or out of line, then notify a Mod in a PM so they can evaluate the situation and do the action deemed necessary.

All moderators do have active "other" lives outside of the forum and help moderate this forum in their spare time throughout the days and weeks.

If you have a problem with a member or Mod follow the proper channels of reporting it.

BKF reserves the right to delete any posts which contain anti-BKF comments or discussion. Any bashing of moderators or administrators, or any of their discussion or actions will also be deleted, and the responsible posting party(s) will be banned. Any public anti-BKF advertising, communication, or posts on another forum will result in permanent bans as well.

All warnings and bans are decided by individual moderators and administrators. Warnings are preferable to bans however, for serious offenses and repeat abusers bans will go into effect. The length of the bans can vary from several hours to permanent.

All BKF users agree not to advertiser on the forum (Niether by posting, private messaging or using your signature). If you are a company/attorney/legal adviser wishing to advertise on the site or sell a product, you must contact the head administrator and inquire about our advertising packages.

You agree not to copy any material/post/content from BKF without written permission from our head administrator .

    I regret not having joined this forum or seeing if it existed back when we filed in April 2002. Other forums and boards existed but were (and still are) inhabited by long-term people on their soap boxes screaming fraud and stupidity. And they themsleves never filed; their purpose is to down and name call posters. Anyway, this forum is not like that - well monitored, many differing thoughts and experiences. Utilimately, the final opinion as to anyone and their finances is with their own attorney but this forum can keep people from making huge mistakes before they seek an attorney (i.e., keeping them from utilizing their 401(k) funds prior to filing because those funds are exempt if you file). Had we known that in 2001 we would not have utilized them to keep from eventually having to file. I think everyone does everything they can to avoid having to file but usually if you think you have to file you usually have to and the time does come.

    I joined this forum just prior to receiving our discharge. My experience is successfully completing a 5 year Chapter 13 and the experience of being able to buy out early (at the 4 year mark) via refinancing with home equity. Our Plan was due to end April 2007 but we refinanced (finality of a 6 to 7 month ordeal to refinance) in April 2006. We also during that time purchased a brand new vehicle at 0% interest, 4 year loan and watched our credit scores rise rapidly since during our Plan we were not late witih anything and followed instructions and orders exactly, reported any extra income and an inheritance received, etc. We were also lucky to have an attorney who answered emails and phone calls and if not available had a fabulous paralegal always available to help or pass on questions.

    The worst time for us was just prior to filing; having to deal with what do we do, all the phone calls and paperwork and the emotional roller coaster ride. I almost had a nervous breakdown trying to keep it together and stay normal in my busy job. And then we began to turn our lives around and start over and do things totally differant than in the past (lifesyle changes, eating out less, becoming budgeting masters, etc., etc.). We filed due to a major job loss of my husband from which he, to this day, has not recovered. It was a struggle to lose 70% of your income and not be able to replace it and without the safe haven of being able to file, we would have lost everything.

    This forum allows one to give their experiences and also for new posters to read those experiences and find out what they can do to avoid problems or what to ask their attorney to also prevent problems. It's the best on the internet for anyone in bankruptcy, considering filing bankruptcy or after bankruptcy.

      This forum has really been a Godsend for me. I have literally read every post available in the forums here. Although every situation is unique, the kindness and honesty found in all of your posts is what has kept me sane. I really feel like everyone is watching each others back, giving encouragement, quelling fears and just offering some sound substantial advice. Thanks to all who share their posts, and thanks for the mods for putting up with us

        I never wanted to file BK. I realized I have to. Filing bankruptcy is not something to talk about with just anyone. Most of my friends and family don't know. Here in this forum, I found lots of information, and found lots of support. THANK YOU FORUM, THANK YOU MEMBERS.

            Joined the forum last week after finally realizing we were getting buried. In many ways it's almost like admitting defeat!
            However, I met a BK attorrney today and he said it can happen to anyone. Told me that Chapter 7 was viable and appropriate. I felt very comfortable in meeting him and quite relieved now.
            Big sigh of relief!!!!!

            Thanks to all for the information. It does help to vent!!

                Our business went under...we had no choice but to file bankruptcy. If it wasn't for this site I would've been lost.

                  it definetly has been a big help. i made an apointment with an attorney cause i knew i just couldnt do it anymore. i was scared and ashamed, i thought the attorney might yell at me or something or ask how stupid i could be to accumulate all that debt. at least coming here i see that many other people are in the same situation and thats its not the end of the world. im still scared tho and have tons of anxiety.

                    Finding this forum has helped me in so many ways. The support here is fantastic, I've gained so much valuable knowledge and its helped me to learn that I am not alone.

                    Its kinda like and AA meeting, only without the crappy coffee and having to stand up in front of a crowd and share

                      Oh this forum is the bomb!! Evryone is very nice, helpful, informative.

                      If I had known about this before I filed BK, wouldn't have hired my useless attorney.
                      Wasted $$$ I couldn't afford (is that tax deductable)??

                        This forum has been incredibly helpful to me, and I'm still a total newbie! In addition to all the great information, it's really helpful emotionally to see the wide range of situations that lead to bankruptcy. I'm still trying to deal with my own ingrained prejudices that BK is a lazy, irresponsible way out for people who are too stupid to manage their money. Seeing all these responsible, intelligent people discussing their own situations and experiences helps me feel like I'm not alone in this, and helps reinforce that just because I made some bad decisions, it doesn't make me a bad person.

                              I have been researching and reading everyone's post for about a month now (since I realized BK was my only option). I just met with a lawyer on Wednesday and dropped off the questionnaire he wanted me to fill out this morning. He was very impressed with my knowledge of all the forms and means test... all of which I gained from lurking about here at the BKforum. He said I will be in for a bumpy ride (for a Chapter 7) since I am 2x the median income for FL. I am sure I will be posting more later with questions and venting! Thank you to everyone who has ever posted here at the forum.

                                This forum has been a godsend ! I was so distraught about the idea of filing BK until I found this place. Once I "educated" myself here somewhat I was ready for step 2, meeting with attorneys and when I found one I was relieved to file...Then I posted about the 341 and how it went and now I am ANXIOUSLY awaiting a discharge !! It's been a long road but because of this forum it hasn't been as bumpy as it would have been and I so appreciate a place where people support each other and don't tear down the already broken !!
